WHISTLEBLOWER RETALIATION
Whistleblower retaliation is a particular type of retaliation in the workplace. It occurs when an employer takes an adverse employment action (like terminating the employee, demoting the employee or cutting the employee’s pay) because
the employee disclosed what the employee reasonably believed was a violation of local, state or federal law. See Labor Code § 1102.5(b). It is in the public interest for employees to be able to raise concerns about potential legal violations in the workplace without fear of retaliation. If employees do not speakup, then employers will be free to continue to engage in illegal behavior at the public’s expense.
